Renungan
"Dan janganlah kamu menghampiri zina, sesungguhnya zina itu adalah satu perbuatan yang keji dan satu jalan yang jahat yang membawa kerosakan." - Maksud Ayat al-Quran Surah al-Israa': 32

PADA suatu majlis ilmu antara waktu maghrib dan isyak di sebuah masjid berhampiran kediaman saya tidak lama dulu, tok guru mengingatkan bahawa setiap Muslim tidak akan terlepas daripada ditanya usaha mereka dalam menunaikan kewajipan agama termasuklah menjayakan hukum jenayah Islam yang terbahagi kepada tiga iaitu hukum hudud, qisas dan takzir.
Tok Guru berkata, dalam menunaikan kewajipan beragama ini ada yang boleh dilakukan sendiri seperti solat dan ada yang tidak boleh dilakukan sendiri, ia membabitkan negara seperti melaksanakan hukum jenayah hudud, qisas dan takzir. Sekalipun ia membabitkan pihak berkuasa, tidak ada Muslim yang terlepas daripada ditanya oleh Allah SWT mengenai peranannya dalam pelaksanaan hukum jenayah ini, kata tok guru.
"Jadi kepada orang awam seperti kita ini, apa kita boleh buat untuk menghadapi pertanyaan Allah nanti?" tanya tok guru yang sendiri menjawab: "Pertama, kita mesti mengaku bahawa hukum-hakam ini wajib ke atas diri kita kerana ia difardukan Allah sama seperti sembahyang dan puasa. Kedua kita mesti berniat untuk melaksanakannya tetapi memohonlah keampunan bersungguh-sungguh kepada Allah kerana tidak ada daya untuk melakukannya.
"Ketiga kita hendaklah mendoakan agar pemimpin yang memerintah kita hari ini terbuka hatinya untuk melaksanakan hukum Allah ini. Kita berdoa bersungguh-sungguh agar mereka dapat menerima Islam sepenuhnya."
"Keempat," kata tok guru, "kita hendaklah membantu sedaya upaya jika ada pihak yang berusaha ke arah melaksanakan hukum-hakam ini, dan yang kelimanya kita tidak pula berusaha menggagalkan pihak yang mahu melaksanakannya termasuklah membantu pihak berkenaan," kata tok guru.
Tok guru mengingatkan selalulah berbuat kebajikan dan jika kita tidak boleh berbuat baik, janganlah berbuat jahat kerana itu sudah dikira ibadat juga. Jika kita tidak mampu membuat kebajikan, jangan pula menghalang orang yang mahu berbuat kebajikan.
Berbicara mengenai bab hudud ini, sebagai seorang Muslim saya dengan rendah diri ingin mengingatkan diri sendiri dan pembaca bahawa ini hukum Allah, setiap Muslim perlu ada niat dan usaha untuk melaksanakannya dan sebagai penulis saya menyatakannya secara terbuka dalam kolum ini.
Hari ini kes jenayah berleluasa. Kenapa jenayah menjadi-jadi? Kenapa orang tidak takut melakukan jenayah? Kenapa suami tergamak mencurah asid atau mengelar kemaluan isteri? Mengapa orang tidak takut berzina dan membuang bayi?
Jawapannya kerana hukam-hakam Allah SWT yang menciptakan manusia tidak tertegak. Dalam hukum-hakam Allah ada kehidupan, itu jaminan-Nya tetapi kita tidak mengendahkannya. Kita berlaku zalim, menggubal dan menuruti hukum-hakam berasaskan nafsu-nafsi manusia. Apabila manusia berani menolak hukum-hakam Allah, mereka sudah menempa kebinasaan diri.
Ambil contoh ketegasan hukum qisas. Hukum qisas yang dari segi bahasanya bermaksud memotong dan dan dari segi syarak bererti hukuman yang ditetapkan oleh syarak melalui nas-nas al-Quran dan hadis-hadis Nabi s.a.w. kerana kesalahan-kesalahan melibatkan hak individu.
Kesalahan-kesalahan yang diwajibkan hukuman qisas ialah membunuh dengan sengaja dan mencederakan anggota tubuh badan seperti mata, hidung dan telinga. Mengikut hukum qisas seseorang penjenayah mesti diikuti dengan hukuman yang sama sepertimana dia lakukan ke atas mangsanya. Kalau ia membunuh maka dia mesti dihukum bunuh.
Allah SWT berfirman maksudnya: " Dan Kami telah tetapkan atas mereka di dalam Kitab Taurat itu, bahawa jiwa dibalas dengan jiwa, dan mata dibalas dengan mata, dan hidung dibalas dengan hidung, dan telinga dibalas dengan telinga, dan gigi dibalas dengan gigi dan luka-luka hendaklah dibalas (seimbang). Tetapi sesiapa yang melepaskan hak membalasnya maka menjadilah ia penebus dosa baginya." (Surah al-Maidah ayat 45)
Dengan tidak tertegaknya hukum-hakam Allah ini, masyarakat tidak menjadi gerun; tidak ada ketakutan bagi mereka melakukan jenayah. Cuba bayangkan bagaimana gentarnya anggota masyarakat untuk membunuh jika mereka tahu pengakhiran mereka dibunuh juga, pencurah asid akan menerima pembalasan dicurah asid ke mukanya pula manakala yang mengelar tubuh mangsa, akan dikelar juga tubuhnya.
Masyarakat juga perlu disedarkan akan mahalnya diat (denda) yang wajib dibayar kerana kesalahan jenayah sebagai ganti qisas. Kadar diat dikira mengikut bilangan unta iaitu harta paling bernilai. Kadar penuh diat 100 ekor unta; jika seekor unta RM3,000, nilaian diat adalah RM300,000!
Bagi jenayah membunuh dengan sengaja, ada dua hukuman iaitu qisas dan diat. Diat hanya boleh dilaksanakan jika dipersetujui oleh waris. Jika tidak, qisas bunuh dikenakan. Pemerintah tidak ada kuasa dalam pengampunan.
Demikianlah hukum-hakam Islam adalah untuk menjaga keselamatan semua; Islam menjaga lima perkara iaitu agama, nyawa, akal, harta dan keturunan. Apabila itu terjaga, terselamatlah semua, bukankah kedatangan Rasulullah s.a.w membawa rahmat kepada seluruh alam. Jadi mengapa kita menolak hukum-hakam-Nya? Tidak sombong dan takaburkah kita?

The hajj - Reflection by a non-Hajji

THE journey from the Plains of Arafat to Muzdalifah and then to Mina is a test of one's endurance - mentally and physically. When hundred thousands of pilgrims convene, perhaps millions, there's bound to be uncertainty that tested one's faith and endurance.
Imagine while performing the hajj 'manasik' (rituals), some pilgrims jostle and scramble to get into their buses. There are cases where the wife has board the bus in Arafat to Muzdalifah on the eve of Aidiladha (Eid), the husband is left behind. There is bound to be havoc and misunderstanding. It is against the spirit of hajj to put on a sour face. Quarrelling is also forbidden what more between husbands and wives.
In the plains of Muzdalifah, pilgrims have a rest; if they choose to lie down; their backs would be on their mats while 'their roof' would be the open sky and stars. While lying down, once a while they could smell the strong stench of animals dung, perhaps during the day that place was a stopover for groups of camels.
It is good to keep one's 'wuduk' (ablution) as to make another one or to go the toilets; pilgrims have to walk a long distance, passing thousands of people and to enter a long queue. Be patience and be patience throughout the night.
While resting in my tent in Mina, my thoughts were on the difficulties faced by some pilgrims when they were on their Arafat-Muzdalifah-Mina journey as told by my mother when she performed hajj years ago.
She said among the difficulties faced by veteran and old pilgrims were the sudden urge to ease oneself. Imagine the old pilgrims who had to answer to the call of nature too often amd they would have to stand long hours in the bus. Nothing could be done except to pray and ask to God that shameful things do not happen during those critical hours.
In case of emergency such as when pilgrims fall ill and are in critical condition, other passengers in the bus could only try their best in helping them but when a pilgrim die, his or her body would be carried in the bus until the bus reaches its destination or could get out from the chaos.

“I thought it is high time to remind myself again this hajj season. I thought it is about time I put my thoughts on the hajj on this special day. I have been keeping it close to my chest until recently.
You see, coming from a person who has not performed the hajj, and the umrah (minor hajj), and currently has no specific timeline when he is going to complete the last pillar of Islam, this reflection is definitely not going to be about the experience in the holy land.
All those great philosophical, eye-opening and heart-warming stories; I have none to tell you. I have only seen the Kaabah on television and pictures; I have only seen a documentary in National Geography on people preparing for and doing the hajj.
Nothing beyond that, I suppose.
I have always wondered when I will be going there. To use the over-used phrase "belum sampai seru" (the call has not come yet) is blasphemous to many. To them, it is like blaming God when you have the willpower and means to decide it yourself. So I can't, and I won't, use that.
And going from the criteria that make the hajj compulsory, I know I have the means and that I am still 'young' and healthy enough to be going soon (man, I never thought I would be able to use the word 'young' and 'I' in the same sentence!).
My mum has been wondering when I would be heading there. Few friends have been asking too. Normally I would smile at them without specifically answering them. Some of them went when they were only in the mid-twenties, which is considered very young by convention.
A year ago, a former schoolmate (An) went to the hajj with his wife Liza (another former classmate). I visited them and after their return, An and I sat at a ‘mamak’ restaurant in PJ; for him to narrate stories from Mecca, and for this non-hajji to benefit the barakah from someone who has just returned.
At the end of it, after hearing many stories from An, I made a confession to him that has always been in my mind when the subject of me heading for the hajj was broached. I had never told anyone before.
"You know, An, I can't imagine myself in the holy land with three million pilgrims and have to fight for basic amenities. Queue to go to the restroom? That was a story unknown to me after 1980.
This is my main worries that kept me away from the holy land. Can I survive the 15 hour journey in a bus? How do I answer the call of nature in the middle of the desert with no water?"
I hate to even share restrooms with strangers in Malaysia.
I guess it is inevitable. He has had that predicament in one of the bus journey in the middle of nowhere.
I made the same confession to a client when I visited her at her office at the twin tower yesterday. I had earlier made a remark that it is not much of a Raya this time around. So she asked me if I had been for hajj myself.
She reckons that may be I have to go for the umrah first to get a feel of it. "Doa banyak-banyak” (pray a lot) and ask for Him to give you the strength."
Of course she herself has horror story about the restrooms there. I shall not repeat it here.
I was reading Harakah this morning while waiting for the Raya solat. It was written by LANH. He noted some of my worries well in his article (the above article).
I guess I am too proud of a person - egoistical, to be more precise. I have to get rid of it. I need to lower myself for me to see Him. I am lowest than lower in many respects. After all 20 years ago when I first started working, I lived in a ‘kampung’ house with only basic amenities in Dungun.
Of course I have a choice but I was just starting out. I had to be very prudent living my life then.
If I can do it twenty years ago, she reckons I can do it today.
I know it may sound petty. It is petty. I know that. But it is these petty things that have kept me away from the Kaabah.
God, please give me the strength to meet you at your abode. Soon.
Yes, Mr Rahmanhariri, it is advisable to perform hajj when one is at a young age. Perhaps the time is right when one is in his thirties or forties because physically and mentally he is fit to fulfill some ‘robust’ obligations that need strength and stamina such as stoning the devils at the jamrahs in Mina.
Furthermore pilgrims have to use the power of their legs for activities such as walking frequently (perhaps five times daily for 'fardu' prayers) from one’s hotel room to the Prophet's Masjid (in Madinah) and Al-Haram Masjid (in Makkah). During hajj, a distance of one or two kilometers from the hotels and the masjids are normal.
For hajj or umrah obligations such as tawaf and sa’ai, one has to walk a distance; for example for sa’ai when one has to walk seven times between the hills of Safa and Marwah, the distance could be more than four kilometers (600 meters x 7)!
When performing the stoning of the devils, it is normal for pilgrims to walk quite a far distance, perhaps two to three kilometers from their tents in Mina to the jamrah. Pilgrims are supposed to stay for four days and three nights in Mina (10, 11, 12 and 13 Zulhijjah) dan stone the three jamras everyday during the stay except during 10th Zulhijjah (Eid) when pilgrims only stone the main jamrah (Jamrah Al-Aqabah).
Thus, to perform hajj one should be physically and mentally fit, so it is advisable to Muslim to take the necessary steps for example started saving from an early age, hoping and praying one could perform the fifth pillar of Islam at the earliest time possible and not at old age.

Isu negara Palestin terus jadi sandiwara Barat

"Dan katakanlah (wahai Muhammad): Beramallah kamu (akan segala yang diperintahkan), maka Allah dan Rasul-Nya serta orang-orang beriman akan melihat apa yang kamu kerjakan; dan kamu akan dikembalikan kepada (Allah) yang mengetahui perkara-perkara ghaib dan yang nyata, kemudian ia menerangkan kepada kamu apa yang kamu telah kerjakan." (Surah At-Taubah, ayat 105)

Bersyukur ke hadrat Illahi kerana kita dipanjangkan usia bagi memuzakarahkan isu-isu membabitkan umat Islam dan sejagat, kali ini kita ingin menyentuh permasalahan Palestin yang masih belum diterima sebagai anggota Pertubuhan Bangsa-Bangsa Bersatu (PBB) sekali gus menjadikannya sebagai sebuah negara berdaulat selepas permohonan dikemukakan presiden Pihak Berkuasa Palestin, Mahmoud Abbas.
Bagi kita sikap berdolak-dalik PBB itu adalah berikutan tekanan Amerika Syarikat dan kuncu-kuncu dalam Majlis Keselamatan seperti Britain dan Perancis. Malah Perancis melalui Presidennya, Nicholas Sarkozy menambah garam di luka apabila mencadangkan Palestin diberi status pemerhati dalam PBB, bukannya sebuah negara beridentiti sendiri. Isu pengisytiharan negara Palestin merdeka bukanlah baru malah tokoh masa lalunya seperti Yasser Arafat mati dengan berputih mata kerana impinan itu tidak terlaksana.
Isu Palestin adalah sandiwara Barat, terutama oleh Amerika Syarikat pimpinan Barack Obama yang berterusan menjalin hubungan kejap dengan rejim Zionis pimpinan Perdana Menteri, Benjamin Netanyahu. Sekalipun Obama ketika pada awal pemasyhurannya sebagai Presiden Amerika berjanji menjalin hubungan baik dengan dunia Islam, hakikat itu hanyalah menanam tebu di bibir, kini Palestin dan rakyatnya terumbang ambing tidak bernegara dan beridentiti (berdaulat) dan akan berterusan menghadapi kekangan, cengkaman, serangan serta pencabulan rejim ganas Zionis.
Kita tertanya-tanya mengapakah nasib rakyat Palestin dan umat Islam minoriti di rantau lain seperti di Kashmir, Xinjiang (China), Selatan Thailand, Selatan Filipina, Chechnya, Arakan (Myanmar-Burma) tidak dihirau masyarakat antarabangsa termasuk badan dunia seperti PBB tetapi rantau bukan Islam seperti Selatan Sudan dan Timor Timur (kini Timor Leste) diutamakan untuk mendapat kemerdekaan, malah tidak menghadapi masalah diiktiraf oleh badan dunia itu.
Kita juga terkilan, dunia Islam dan Pertubuhan Persidangan Islam (OIC) yang memayungi lebih 50 negara umat Islam, berterusan mendiamkan diri dalam permasalahan Palestin ini.OIC yang ditubuhkan pada 25 September 1969 selepas berlaku kebiadapan Yahudi membakar Masjid al-Aqsa iaitu kiblat pertama umat Islam, dilihat bisu dalam isu tuntutan Palestin sebagai negara berdaulat.
Kita saksikan OIC lesu dalam menangani permasalahan ummah apatah lagi pada peringkat lebih tinggi seperti permohonan Palestin untuk diiktiraf sebagai negara berdaulat in. Hari ini isu kebiadapan rejim Zionis-Yahudi yang menjadi titik tolak penubuhan OIC tetap gagal ditangani.
Tangan-tangan zalim rejim Zionis berterusan mencemar kesucian al-Aqsa dan kawasan sekitarnya di Haram al-Sharif (Temple Mount) manakala nasib orang Palestin tidak berubah sejak puluhan tahun lalu malah menjadi semakin buruk. Ekstremis Yahudi bertindak berani mengorek terowong di bawah al-Aqsa, tetapi apa reaksi ummah, negara dan organisasi yang memayungi mereka? Jika badan dunia seperti PBB tidak dapat diharapkan, mengapa OIC, negara dan umat Islam masih lena tidur?
Apabila umat Islam dan organisasi memayungi mereka seperti OIC membisu, musuh-musuh semakin berani menindas dan menghina umat Islam di seluruh dunia. Lihatlah apa yang terjadi kepada saudara se-Islam di negara di mana mereka kumpulan minoriti seperti di Myanmar, China, Rusia, Thailand, India dan Filipina.
Muslim Rohingya, Uighur, Chechnya, Melayu, Kashmir dan Moro menjadi mangsa; sesetengahnya diperangi dan dihalau dari kampung halaman masing-masing. Namun apa dibuat oleh OIC dan negara Islam yang bernaung dalam organisasi ini? Paling kuat mereka mengeluarkan kenyataan mengutuk, lebih menyedihkan sebahagian besar daripadanya memilih membisu seribu bahasa.
Bukan saja umat Islam minoriti dizalimi, malah negara ummah anggota OIC seperti Iraq dan Afghanistan dijarah sepuas-puasnya oleh kuasa biadap tetapi ummah terutama pemimpin mereka mendiamkan diri. Tiada yang berani menyatakan yang hak dan batil malah ada pemimpin bersengkokol dengan musuh untuk menghancurkan Islam.
Kemudian pemimpin zalim, sekutu dan pengikutnya yang menjarah negara umat Islam tanpa segan silu menuduh pula orang Islam sebagai pengganas dan memburu mereka di seluruh dunia. Umat Islam mengiyakan saja, malah sesetengahnya berganding tenaga membantu musuh. Dengan bantuan media massa dikuasai mereka, maka tergambarlah seolah-olah penganut Islam itu ganas, agama itu menganjurkan keganasan.
Berhubung permasalahan Palestin ini, OIC, pemimpin dan ummah perlulah bermuhasabah diri, mengkoreksi dan memperbaiki apa-apa kelemahan yang menyebabkan umat Islam seluruh dunia dihina sedemikian rupa. Hakikatnya selepas kebanyakan tanah air umat Islam dijarah penjajah dan daulah Khilafah Islam terakhir, Uthmaniyah tersungkur pada 1924, kehidupan umat semakin jauh daripada panduan Allah dan Rasul-nya termasuk dari segi pemerintahan.
Kita yakin selagi umat Islam terutama pemimpinnya tidak kembali kepada panduan Allah dan Rasul-nya (termasuk melaksanakan semua hukum hakam Islam tidak terkecuali hudud) selagi itu penghinaan akan dihadapkan kepada umat ini. Kini dari China ke Afrika Selatan, dan dari Amerika Syarikat ke Australia, umat Islam hidup penuh tekanan sehinggakan di negara yang mengaku negara Islam contoh, hukum-hakam Islam dicemuh walaupun baru ada ura-ura melaksanakan sebahagian daripadanya.
Bagi kita, berapa banyak pun sidang OIC, selagi sebahagian besar pemimpinnya dan juga pemimpin negara umat Islam masih berkiblatkan Washington, London dan Moscow, selagi itulah ummah akan dihina. Kita cukup bimbang selepas Iraq dan Afghanistan, ada lagi negara umat Islam akan menjadi mangsa; gara-gara ummah tidak kembali kepada panduan Allah dan Rasul-Nya.
DENGAN nama Allah Yang Maha Pemurah Lagi Maha Penyayang; selawat dan salam ke atas junjungan besar Nabi Muhammad s.a.w.

"Dan katakanlah (wahai Muhammad): Beramallah kamu (akan segala yang diperintahkan), maka Allah dan Rasul-Nya serta orang-orang beriman akan melihat apa yang kamu kerjakan; dan kamu akan dikembalikan kepada (Allah) yang mengetahui perkara-perkara ghaib dan yang nyata, kemudian ia menerangkan kepada kamu apa yang kamu telah kerjakan." (Surah At-Taubah, ayat 105)

Bersyukur ke hadrat Illahi kerana kita dipanjangkan usia bagi memuzakarahkan isu-isu membabitkan umat Islam dan sejagat, kali ini kita ingin menyentuh permasalahan Palestin yang masih belum diterima sebagai anggota Pertubuhan Bangsa-Bangsa Bersatu (PBB) sekali gus menjadikannya sebagai sebuah negara berdaulat selepas permohonan dikemukakan presiden Pihak Berkuasa Palestin, Mahmoud Abbas.
Bagi kita sikap berdolak-dalik PBB itu adalah berikutan tekanan Amerika Syarikat dan kuncu-kuncu dalam Majlis Keselamatan seperti Britain dan Perancis. Malah Perancis melalui Presidennya, Nicholas Sarkozy menambah garam di luka apabila mencadangkan Palestin diberi status pemerhati dalam PBB, bukannya sebuah negara beridentiti sendiri. Isu pengisytiharan negara Palestin merdeka bukanlah baru malah tokoh masa lalunya seperti Yasser Arafat mati dengan berputih mata kerana impinan itu tidak terlaksana.
Isu Palestin adalah sandiwara Barat, terutama oleh Amerika Syarikat pimpinan Barack Obama yang berterusan menjalin hubungan kejap dengan rejim Zionis pimpinan Perdana Menteri, Benjamin Netanyahu. Sekalipun Obama ketika pada awal pemasyhurannya sebagai Presiden Amerika berjanji menjalin hubungan baik dengan dunia Islam, hakikat itu hanyalah menanam tebu di bibir, kini Palestin dan rakyatnya terumbang ambing tidak bernegara dan beridentiti (berdaulat) dan akan berterusan menghadapi kekangan, cengkaman, serangan serta pencabulan rejim ganas Zionis.
Kita tertanya-tanya mengapakah nasib rakyat Palestin dan umat Islam minoriti di rantau lain seperti di Kashmir, Xinjiang (China), Selatan Thailand, Selatan Filipina, Chechnya, Arakan (Myanmar-Burma) tidak dihirau masyarakat antarabangsa termasuk badan dunia seperti PBB tetapi rantau bukan Islam seperti Selatan Sudan dan Timor Timur (kini Timor Leste) diutamakan untuk mendapat kemerdekaan, malah tidak menghadapi masalah diiktiraf oleh badan dunia itu.
Kita juga terkilan, dunia Islam dan Pertubuhan Persidangan Islam (OIC) yang memayungi lebih 50 negara umat Islam, berterusan mendiamkan diri dalam permasalahan Palestin ini.OIC yang ditubuhkan pada 25 September 1969 selepas berlaku kebiadapan Yahudi membakar Masjid al-Aqsa iaitu kiblat pertama umat Islam, dilihat bisu dalam isu tuntutan Palestin sebagai negara berdaulat.
Kita saksikan OIC lesu dalam menangani permasalahan ummah apatah lagi pada peringkat lebih tinggi seperti permohonan Palestin untuk diiktiraf sebagai negara berdaulat in. Hari ini isu kebiadapan rejim Zionis-Yahudi yang menjadi titik tolak penubuhan OIC tetap gagal ditangani.
Tangan-tangan zalim rejim Zionis berterusan mencemar kesucian al-Aqsa dan kawasan sekitarnya di Haram al-Sharif (Temple Mount) manakala nasib orang Palestin tidak berubah sejak puluhan tahun lalu malah menjadi semakin buruk. Ekstremis Yahudi bertindak berani mengorek terowong di bawah al-Aqsa, tetapi apa reaksi ummah, negara dan organisasi yang memayungi mereka? Jika badan dunia seperti PBB tidak dapat diharapkan, mengapa OIC, negara dan umat Islam masih lena tidur?
Apabila umat Islam dan organisasi memayungi mereka seperti OIC membisu, musuh-musuh semakin berani menindas dan menghina umat Islam di seluruh dunia. Lihatlah apa yang terjadi kepada saudara se-Islam di negara di mana mereka kumpulan minoriti seperti di Myanmar, China, Rusia, Thailand, India dan Filipina.
Muslim Rohingya, Uighur, Chechnya, Melayu, Kashmir dan Moro menjadi mangsa; sesetengahnya diperangi dan dihalau dari kampung halaman masing-masing. Namun apa dibuat oleh OIC dan negara Islam yang bernaung dalam organisasi ini? Paling kuat mereka mengeluarkan kenyataan mengutuk, lebih menyedihkan sebahagian besar daripadanya memilih membisu seribu bahasa.
